Unfair dismissal, can anyone help?

I have worked for the same company for nearly four years, but had a break for two months ( went to work elsewhere ), after the break I worked for them for a furhter 6 months, handed my notice in after that, but was then dismissed during my notice period! My case has already been accepted by the tribunal but I have been told that my last employer will apply for all their solicitors fees to be reimbursed by myself if I was unsuccessful, don't know if it is worth the risk, ACAS haven't been really helpful on the matter and they seem to take my ex employer side, what should I do?
