Can Marvel still make live - action Tv shows?

Fox already sued Marvel for creating "Mutant X" since they considered it too similar to the X-Men franchise. If Fox isn't going to allow Marvel to create a TV series similar to those franchises (even though it had nothing to do with the X-Men) then it is very doubtful that Fox will allow them to make a series that is actually based on them.
